Terms of Service

These terms govern your use of the Daily Weather Brief (the "Service"). By signing up, you agree to them.

1. About the Service

The Daily Weather Brief is operated by Blake Sullivan (sole proprietor) at dailywxbrief.com. The Service summarizes publicly available NOAA Storm Prediction Center convective outlooks into a plain-language morning email, delivered only on days when there's at least a Slight Risk in your selected states.

2. Eligibility

You must be at least 18 years old and a resident of the United States to subscribe. By signing up, you confirm both. We currently do not offer the Service outside the US.

3. Account information

You're responsible for giving us accurate information (email, name, ZIP code, state preferences) and keeping it current. We use the email you provide to deliver the Service; if it's wrong, we can't deliver.

4. Subscription and billing

The Service is offered on a recurring subscription basis:

All payments are processed by Stripe; we never see or store your card number. You authorize us (via Stripe) to charge your payment method automatically at each renewal until you cancel.

5. Free trial

New subscriptions include a 14-day free trial. We collect your payment method upfront but don't charge until the trial ends. Cancel anytime during the trial and you won't be charged.

6. Cancellation and refunds

You may cancel at any time via the one-click link in any email or via the Stripe Customer Portal. Full details, including how cancellation timing works for trial / monthly / annual, are in our Cancellation Policy.

We do not issue refunds for paid subscription periods. If you cancel, you keep using the Service through the period you've already paid for; you simply aren't charged for the next period.

7. Service availability

We aim for the Service to run every morning around 14:00 UTC, but we can't guarantee 100% uptime. Briefs depend on third-party systems (NOAA SPC, our cloud provider, our email provider). Outages happen. A missed day is not grounds for a refund.

8. No warranty — informational only

The Daily Weather Brief is informational only and is not a substitute for official weather warnings. Always defer to the National Weather Service and your local emergency management for life-safety decisions.

Weather is inherently unpredictable. No forecast — including this one — can predict or warn of every weather event. You acknowledge and assume all risks associated with your decisions and actions taken in response to (or in absence of) information in the Service, including risks of personal injury, death, and property damage.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Blake Sullivan or the Daily Weather Brief be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to personal injury, death, property damage, loss of profits, loss of data, loss of use, or loss of goodwill — arising out of your use of (or inability to use) the Service, your reliance on any information in the Service, your decisions or actions taken in response to (or in the absence of) any forecast or notification, or any weather event or condition mentioned in or omitted from the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50.

10. Indemnification

You agree to indemnify and hold harmless Blake Sullivan from any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Acceptable use

You agree not to: (a) resell, redistribute, or scrape the Service's content without permission; (b) use the Service for any unlawful purpose; (c) attempt to gain unauthorized access to our systems or other subscribers' accounts; (d) sign up other people's email addresses without their consent. We may suspend or terminate accounts that violate these rules without notice.

12. Modifications

We may modify the Service or these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, communicated by email. Continued use of the Service after changes constitutes acceptance.

13. Termination

You may terminate your subscription at any time per the Cancellation Policy. We may terminate or suspend your access for violation of these Terms, for non-payment, or for any other reason at our discretion. On termination, all rights you have to use the Service end.

14. Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Oklahoma, and you consent to the jurisdiction of those courts.
